1.1. The entity running the online store via the Internet, operating at www.pintowear.com is Designed By Monika Trescher, based at Pl. Wiosny Ludów 2, 61-831 Poznań (hereinafter referred to as „PINTO”), entered in the Central Register and Information on Business Activity, having REGON: 389109008, NIP: 8911523534.
1.2. The customer has the opportunity to contact the operator of the online store in any of the following ways:
– by phone at the hotline number for landlines and cell phones: 690 120 140 (cost according to the operator’s tariff),
– via email to: kontakt@pintowear.com,
– via the contact form on the online store website at www.pintowear.com.
2.1. The online store can only be used by people who are at least 18 years old.
2.2. Persons registering in the online store and making purchases there provide their personal data, which PINTO processes according to the principles indicated in the Privacy Policy.
3.1. Orders are accepted through the website www.pintowear.com.
3.2. The goods in the online store are marked in detail. Among other things, the website provides information about the characteristics of the goods, their price, the material from which they are made.
3.3. When ordering goods, the customer selects the goods in a manner appropriate to the item, specifying in particular the size, color, number of pieces, and, if necessary, providing other specific information.
4.1. After the customer selects the goods in a particular size, click the „Add to cart” icon.
4.2. The product is transferred to the shopping cart, which is visible in the upper right corner of the page. After selecting the „Finalize order” option, if the customer is not already logged in, he is transferred to the login / account creation panel.
4.3. In the login / account creation panel, you need to enter the customer data necessary to complete the transaction and ship the ordered goods.
4.4. After creating an account / logging in, the customer gains access to additional options in the customer panel, such as: order history; the ability to check at what stage the last order placed is; remembering shipping addresses.
4.5. Once you have entered all the necessary data (including, if applicable, invoice data), you will need to select your payment method and delivery method.
4.6. The customer has the option to select one of the currently available payment methods in the section – Select payment – online payment or pay for the shipment on delivery.
4.7. The customer confirms the order by clicking on the „Proceed to payment” button.
4.8. If the customer has chosen online payment, after payment is made, he is redirected to the order confirmation page.
4.9. If PINTO does not receive online payment, the order is not considered properly placed, which means that the contract does not come into effect and the order will not be fulfilled.
4.10. At any stage of ordering, until payment is made, you can cancel the order by stopping going through the steps and exiting the ordering subpage. An order whose submission process is not brought to completion by the customer is considered cancelled and will not be processed.
4.11. Immediately after the order is placed, an e-mail confirming the order will be sent to the Customer’s e-mail address provided in the login information. In the content of this message, the customer will receive an individualized order number, which, among other things, allows you to provide. Determining the status of the order.
4.12. PINTO may contact the Customer at the e-mail address provided by the Customer or by telephone, at the contact telephone number provided by the Customer, in order to clarify doubts, confirm the order, or on any other issues related to the order.
5.1. Prices on the website of the online store given in Polish zloty are gross prices, including VAT.
5.2. No additional shipping cost of the goods is added to the price of the goods, except for shipments outside the Republic of Poland.
5.3. The price listed on the site at the time of ordering is the final price, binding on both the customer and PINTO. Once the order has been placed, the price of the ordered goods will not change, regardless of price changes introduced by PINTO or promotional or sales actions launched.
5.4. PINTO reserves the right to change prices of goods in the online store, introduce new goods for sale, carry out and cancel promotional actions on the store’s pages or make changes to them.
6.1. All goods offered in the online store are available goods.
6.2. In exceptional situations, e.g., when multiple customers place an order for the same goods at the same time, it may happen that the goods are not available. In such a situation, the customer will be informed that the order cannot be completed.
6.3. Full information on the range of available sizes is made available in the product card.
In the event that a particular item is out of stock or the order cannot be fulfilled for any other reason, the customer will be informed by e-mail or telephone. In particularly justified cases, PINTO may refuse to conclude a sales contract to protect its assets.
8.1. The goods are delivered in Poland, Germany, UK, USA, France, Italy, Spain, Portugal, Sweden, Norway, Finland, Ireland, Canada, Switzerland, Austria, Czech Republic, Slovakia, Slovenia, Hungary, Latvia, Lithuania and Estonia.
8.2. If you choose the payment method „cash on delivery”, the order is transferred for processing immediately after its submission. If you choose one of the methods of online payment, the order is transferred for processing after confirmation of receipt of payment for the ordered goods.
8.3. If the selected goods are available, the delivery time is from 1 to 3 business days from the date of successful order placement.
8.4. Delivery times may be extended during periods of sales or special campaigns.
8.5. NOTE: If you choose as a form of payment, one of the currently available online payments, order processing begins after 100% of the payment for the order has been received, from this point on, the date within which the goods will be delivered to the customer should be counted.
8.6. Delivery of orders within Poland is handled by a courier company selected by PINTO. The cost of the courier company is borne by PINTO.
8.7 Delivery of orders outside Poland, to the countries indicated in paragraph 8.1 is handled by a courier company selected by the Customer, from among those available in the online store. The cost of shipping and the threshold from which delivery is free can be found at the end of the terms and conditions.
8.8. PINTO also provides the opportunity to pick up your order free of charge at the PINTO showroom, located in the Kupiec Poznański Gallery in Poznań, Pl. Wiosny Ludów 2, during the salon’s business hours.
9.1. Cash on delivery: option available only when ordering to a designated address in Poland.
9.2. Transfer: traditional transfers and online transfers made using the payment method selected by the Customer are available, i.e. service from one of PINTO’s partners. In the case of online transfers, after making a selection, the customer is securely redirected to the site of the payment provider of his choice. The payment operation is carried out between the customer and the selected payment operator.
9.3. Payment card: if the Customer is the holder of a card that allows online payments (you should check with the issuing bank about whether the card meets this condition), the payment is made through the PINTO partner selected by the Customer. The payment operation is carried out between the customer and the operator of the card held by the customer.
Depending on the type of delivery option selected by the Customer, PINTO undertakes to forward the goods for shipment to the Customer within 1 business day of correct placement of the order. In case of shortage of goods or inability to complete the order for any other reason, PINTO will immediately contact the Customer proposing possible solutions in the given situation. Working days are calculated from Monday to Friday, excluding public holidays.
11.1. The customer has the right to withdraw from the contract of sale of goods, without giving any reason (the so-called return of goods).
11.2. The right to withdraw from the contract expires 100 days after the day on which the Customer took possession of the goods or on which a third party other than the carrier and indicated by the Customer took possession of the goods.
11.3. In order to exercise the right of withdrawal, the Customer shall make an unequivocal statement of withdrawal to PINTO in one of the indicated ways:
– By mail to the address: PINTO Designed by Monika Trescher, Pl. Wiosny Ludów 2, 61-831 Poznań,
– by sending an email to: kontakt@pintowear.com,
– by completing and submitting an online form, available in the Customer panel for each order; if this form is used, the Customer will receive immediate confirmation that PINTO has received his/her withdrawal statement.
Note! Any of the ways of sending the statement is permissible and all are equivalent in terms of effectiveness. PINTO recommends only using the online form available in the customer panel for the sole reason of ease and speed of making a statement.
11.4. To comply with the deadline for withdrawal from the sales contract, it is sufficient for the Customer to send information regarding the exercise of the Customer’s right of withdrawal before the expiry of the 100-day period referred to in Section 11.2. above.
11.5. In the event of withdrawal from the sales contract, PINTO shall return the payments received to the Customer no later than 14 days from the day PINTO was informed of the Customer’s decision to exercise the right to withdraw from the sales contract, subject to Section 11.7. below. If PINTO misses the deadline for returning the payment, PINTO will independently add statutory interest to the returned payment.
11.6. Refunds will be made using the same means of payment used by the Customer in the original transaction, unless the Customer expressly agrees otherwise. In any case, the customer will not incur any fees in connection with the refund by any means other than the method of payment for the goods.
11.7. PINTO may withhold payment until it has received and inspected the returned item.
11.8. Items should be sent back to the address: PINTO Designed by Monika Trescher, Pl. Wiosny Ludów 2, 61-831 Poznań, immediately, and in any case no later than 14 days from the day on which the Customer informed PINTO about withdrawal from the sales contract. The deadline is met if the customer sends the item back before the expiration of the 14-day period.
11.9. The return of the item is made by the customer at his expense.
11.10. The customer shall be liable for any diminution in the value of the item resulting from the use of the item other than what was necessary to ascertain the nature, characteristics and functioning of the item.
12.1. Items for sale are new products without defects. In the event of product defects, PINTO is liable for the defects.
12.2. Any item purchased in PINTO’s online store may be claimed, in accordance with the provisions of the Civil Code on warranty on sale, if a defect in the item (including non-conformity of the goods with the contract) is found within two years of its release to the customer.
12.3. Complaints can be submitted by mail or online. Indicate the reasons for the complaint and the information necessary to identify the order. To lodge a complaint, PINTO’s recommended „Complaint” form (available on the website, in the customer panel, with each order) can be used, which can be filled out online or printed out, and then returned to the address: PINTO Designed by Monika Trescher, Pl. Wiosny Ludów 2, 61-831 Poznań.
12.5. PINTO allows customers making a complaint to send back defective goods by courier at PINTO’s expense. For this purpose, it is required that the customer fill out an electronic complaint form (available in the customer panel) with address details, from where the courier should pick up the shipment with the advertised products. The rules indicated in Section 13.9 of the Regulations shall apply to the exercise of this option.
12.6. PINTO will consider the complaint within 14 days and will inform the Customer of the manner in which the complaint was resolved via email or text message.
12.7. In the case of a successful complaint filed by mail, the customer will receive a refund for the goods, and the refund of the incurred, expedient costs of sending the defective goods to the e-shop – after sending a copy / scan of the proof of their incurrence to the e-mail address: kontakt@pintowear.com.
12.8. If the complaint is not accepted, the customer will be informed of the reasons for non-recognition of the complaint to the e-mail address shown in the order, and the goods will be sent back to the address from which the complaint was sent.
The customer has the option to cancel the order himself, within fifteen minutes of placing the order, in the customer panel, under the „Orders” tab, by clicking the „Cancel order” button next to the order in question.
14.1. If an invoice is requested, the customer shall provide the necessary data, whereby the provision of the Tax Identification Number for the invoice shall be made no later than when placing the order.
14.2. PINTO is not responsible for incorrect or incomplete invoice data provided by the Customer.
14.3. In the case of corrective invoices, these Regulations constitute documentation agreeing to the terms of the correction within the meaning of Art. 29a para. 13 of the March 11, 2004 Law. on Value Added Tax and acceptance on the part of the client that the moment of reduction of the amount of VAT charged in the settlement for a given period is the moment of issuance of a corrective invoice by PINTO. PINTO issues a correction invoice when the goods are returned to PINTO, which is the fulfillment of the conditions for issuing a correction invoice.
In order to maintain the User’s account and to conclude and perform sales agreements, as well as to perform the seller’s obligations arising from the fact of concluding sales agreements at a distance, PINTO processes the Customer’s personal data, which the Customer provides voluntarily. All information regarding the processing of personal data can be found in the Privacy Policy tab.
Foreign shipping costs, depending on the currency of payment, according to the purchase value of the currency from the table located at: Exchange rates | Santander, updated on a weekly basis (currently the adopted rate as of 18/10/2022). The table also indicates the limit from which shipping outside Poland is free.
